Read this carefully before installing or using ChronoPill. By downloading, installing, or using the app or this website, you acknowledge that you have read, understood, and agreed to every clause below. If you do not agree, do not install the app and do not use this website.

1. Not a Medical Device

ChronoPill is a general-purpose consumer information and reminder tool. It is not a medical device under FDA 21 CFR 880.6315, the FDA Clinical Decision Support guidance (December 2022), the EU Medical Device Regulation (MDR) 2017/745, Health Canada, MHRA, PMDA, or any equivalent national framework. ChronoPill is not certified, cleared, registered, or approved by any regulatory authority for any clinical, diagnostic, therapeutic, or monitoring use.

ChronoPill does not:

Diagnose, prescribe, treat, cure, monitor, or prevent any disease, condition, symptom, or medical event;
Provide medical advice, professional medical opinions, pharmaceutical guidance, or clinical decision support;
Replace, supersede, or substitute for the judgement of a licensed physician, pharmacist, nurse, or any other qualified healthcare professional;
Constitute a "device" or "software function" intended to acquire, process, store, analyze, or interpret patient-specific medical information for clinical purposes;
Guarantee the accuracy, completeness, currency, or appropriateness of any information related to medications, drug interactions, dosages, side effects, contraindications, or pharmacokinetics displayed by the app.

DO NOT USE CHRONOPILL IN MEDICAL EMERGENCIES. If you experience symptoms of a medical emergency (chest pain, stroke symptoms, severe allergic reaction, suspected overdose, suicidal thoughts, or any acute condition), call 911 (US), 112 (EU), or your local emergency number immediately. Do not delay emergency care to consult any information shown by ChronoPill.

High-risk populations. ChronoPill is not designed or validated for use by, or with respect to, the following populations, and any reliance on the app by or for these populations is at your sole risk: pregnant or breastfeeding individuals; infants, children, or adolescents under 18; adults aged 65 and over; individuals with hepatic or renal impairment; individuals with rare or orphan diseases; individuals on chemotherapy, immunosuppressants, anticoagulants, or controlled substances; and individuals participating in clinical trials. Always consult a qualified healthcare professional before relying on any reminder, dose timing, or interaction warning shown by the app for these populations.

2. Information "As Is" - No Warranty

All content displayed by ChronoPill, including but not limited to drug names, dosages, scheduling rules, interaction warnings, side-effect predictions, fasting schedules, travel-equivalence suggestions, and clinical summaries, is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied. To the maximum extent permitted by applicable law, we disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, uninterrupted service, error-free operation, or compatibility with any device or operating system.

Drug databases are updated periodically from third-party sources (openFDA, DailyMed, ANSM BDPM, public registries). We make no representation that these sources are accurate, current, or comprehensive. Errors, omissions, and out-of-date information may occur.

3. Limitation of Liability

To the fullest extent permitted by law, in no event shall ChronoPill, its founders, employees, affiliates, partners, contractors, agents, suppliers, or licensors be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or any other damages whatsoever (including without limitation damages for loss of profits, loss of data, loss of goodwill, business interruption, personal injury, illness, hospitalization, death, allergic reaction, drug interaction, missed dose, incorrect dose, or any other harm) arising from or related to:

Your use of, or inability to use, ChronoPill or this website;
Any reminder that did not fire, fired late, fired at the wrong time, or contained incorrect information;
Any drug interaction, contraindication, side effect, or dosage that ChronoPill failed to flag, flagged incorrectly, or flagged late;
Any reliance you placed on any information provided by ChronoPill;
Any bug, defect, software error, server downtime, data loss, account lock-out, payment failure, or third-party service failure;
Any unauthorized access to, alteration of, or destruction of your data;
Any decision you made, or refrained from making, based on information displayed by ChronoPill.

Our total aggregate liability to you for all claims arising from or related to ChronoPill, whether in contract, tort, statute, or otherwise, shall not exceed the greater of (a) the amount you paid us for the app or in-app purchases in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty United States dollars ($50.00). Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you in part or in whole.

4. Indemnification

You agree to defend, indemnify, and hold harmless ChronoPill, its founders, employees, affiliates, agents, contractors, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of and access to ChronoPill; (b) your violation of these terms; (c) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right; or (d) any claim that information you submitted to ChronoPill caused damage to a third party.

5. Binding Arbitration & Class Action Waiver (US users)

If you reside in the United States, you and ChronoPill agree that any dispute, claim, or controversy arising out of or relating to this Disclaimer, the Terms of Service, or the use of ChronoPill, shall be resolved by binding individual arbitration administered by JAMS in accordance with its then-current Streamlined Arbitration Rules. The arbitration shall take place in San Francisco, California, in English, and judgement on the award may be entered in any court of competent jurisdiction.

YOU WAIVE THE RIGHT TO TRIAL BY JURY AND THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR OTHER REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

Right to opt-out: you may opt out of this arbitration agreement by sending written notice to legal@chronopill.com within 30 days of first downloading the app. The notice must include your full name, address, the email address tied to your account, and a clear statement that you wish to opt out of arbitration.

6. Governing Law & Jurisdiction

For users in the United States, these terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. For users in the European Union, the United Kingdom, Switzerland, and the EEA, the mandatory consumer-protection laws of your country of residence shall apply where they grant greater protection. Any non-arbitrable dispute shall be brought exclusively before the competent courts of Paris, France for EU/EEA users, or Wilmington, Delaware for US users.

7. Third-Party Services

ChronoPill integrates with third-party services including but not limited to Apple HealthKit, Apple StoreKit, Apple Push Notification service, openFDA, DailyMed, ANSM BDPM, Doctolib, FreeDeSk, AWS, and Google Cloud. We are not responsible for the availability, accuracy, content, or practices of any third-party service. Your use of these services is governed by their respective terms.

8. Pricing, Subscriptions, Refunds

All in-app purchases are processed by Apple via the App Store. Pricing is shown in your local currency before any charge. Subscriptions auto-renew at the same period and price unless cancelled at least 24 hours before the end of the current period via your Apple ID Subscription settings. Refund requests must be submitted directly to Apple at reportaproblem.apple.com; ChronoPill does not have the technical ability to process Apple-mediated refunds. Promotional pricing, free trials, and discount codes are subject to change or withdrawal at any time without notice.

9. No Doctor-Patient Relationship

Use of ChronoPill does not create a doctor-patient, pharmacist-patient, or any other professional healthcare relationship between you and ChronoPill or any of its personnel. ChronoPill does not provide telemedicine, prescription, or pharmacy services. Any educational content shown in the app is for informational purposes only.

10. International Use, Export Controls

The app is offered globally but is designed primarily for users located in countries where its drug databases are supported (United States, France, Spain, Japan, Canada at the time of writing). Use elsewhere is at your own risk; drug names, dosages, regulations, and clinical practice may differ. You are responsible for compliance with all applicable local laws, including but not limited to import/export controls, controlled-substance regulations, and customs declarations when traveling.

11. Severability & Survival

If any provision of this Disclaimer is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary; all other provisions remain in full force and effect. The provisions on Limitation of Liability, Indemnification, Arbitration, and Governing Law survive termination of these terms.

12. Changes to This Disclaimer

We may update this Disclaimer at any time. Material changes will be posted on this page with a revised "Last updated" date. Continued use of ChronoPill after such posting constitutes your acceptance of the updated terms.

13. Apple App Store License Notice

This section applies if you obtained ChronoPill from the Apple App Store. It is required by Apple's Developer Program License Agreement (Schedule 1) and is in addition to, not a replacement for, the other provisions of this Disclaimer and the Terms of Service.

Acknowledgment. You and ChronoPill acknowledge that this Disclaimer and the Terms of Service form a contract concluded between you and ChronoPill only, and not with Apple Inc. or any Apple subsidiary ("Apple"). ChronoPill, not Apple, is solely responsible for ChronoPill and its content.
Scope of license. The license granted to you for ChronoPill is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that ChronoPill may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
Maintenance and support. ChronoPill is solely responsible for providing any maintenance and support services with respect to ChronoPill. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to ChronoPill.
Warranty. ChronoPill is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of ChronoPill to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to ChronoPill, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of ChronoPill.
Product claims. ChronoPill, not Apple, is responsible for addressing any claims by you or any third party relating to ChronoPill or your possession and/or use of ChronoPill, including but not limited to: (i) product liability claims; (ii) any claim that ChronoPill fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with HealthKit and HomeKit.
Intellectual property. In the event of any third-party claim that ChronoPill or your possession and use of ChronoPill infringes that third party's intellectual property rights, ChronoPill, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party beneficiary. You and ChronoPill acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this Disclaimer and the Terms of Service, and that, upon your acceptance of these terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary thereof.
